American Marketing & Publishing (“AMP”) has created this privacy statement (“Statement”) in order to demonstrate our commitment to privacy. Privacy of company web sites and other data owned by or controlled by AMP is of great importance to us. Because we gather important information from our customers and the consumers who opt-in to join their text marketing lists or our text marketing lists, we have established this Statement to communicate our information gathering and dissemination practices.
To avoid unsolicited messages and as a part of our privacy policy, AMP requires that consumers opt in to the text programs or other marketing programs that we or our Customers run using our text marketing services. Our business policies and contractual agreements with our vendors and our customers also require that consumers be allowed to opt-out of a text marketing program at any time.
AMP reserves the right, in its sole discretion, to modify or change this Privacy Policy at any time with or without prior notice to you. Information Collection / Opt-Out
AMP provides its Customers (most typically businesses but also civic or religious organizations, governmental units individuals, or other entities) the tools and resources to collect the mobile phone numbers of their customers or other consumers on an opt-in basis using mobile keywords. A consumer can elect to join our Customers’ text marketing distribution lists by texting a specific keyword for that Customer to short code 36000 which will allow the Customer to send periodic information or offers via text to that consumer (“Subscriber”). Subscribers have the ability to opt out of our Customer’s distribution lists easily.
Mobile Keywords and Mobile Phone Numbers
We collect mobile phone numbers when Subscribers text our Customers’ mobile keyword (assigned by AMP) to one of AMP’s short codes. By texting a mobile keyword to our short code, Subscribers are opting-in their mobile phone number to join our Customer’s text marketing distribution list. Subscribers are also giving implied consent for a Customer to send them text messages and to allow that Customer to view and access their mobile phone number. Subscribers can remove their mobile phone numbers from a Customer’s list at any time by replying to any text message they receive from the Customer via the AMP text marketing service with any of the following words: STOP, END, CANCEL, STOPALL, UNSUBSCRIBE and STOP (+ any keyword.)
Additional Types of Personal or Commercial Information We May Record and Collect
Contact Information that allows us to communicate with you if you supply it to us in the process of purchasing from us or inquiring about our services, such as your name, postal addresses, email addresses, telephone numbers, or other addresses at which you receive communications from or on behalf of AMP.
Transaction Information about how you interact with AMP or AMP Sites, such as information about how you use our Sites, the volume and content of text messages sent and received, and the opt-in text marketing lists you have joined or opted-out of, and your subscriber list (relating but not limited to the number and frequency of opt ins, opt outs, as well as the subscriber mobile phone carrier).
Financial Account Information as needed to permanently record and process payments for print or text marketing services or other services or products that you buy, such as your banking information, credit or debit card number, expiration date, and card verification number.
User’s Site or Service Utilization Data or User Preference Data and other Visitor Information that helps us to understand how you prefer to use our Sites and what information or offers are most appealing or of greatest interest to you, as well as any demographic information that you provide to us such as birth date, age, or gender.
Security
AMP takes precautions to protect data and information owned by it or under its control from misuse, loss or alteration. AMP utilizes some of the most advanced technology for Internet security available today. AMP maintains security measures to allow only the appropriate personnel access to your information. Unfortunately, no system can ensure complete security, and AMP disclaims any liability resulting from use of the Site or Services.
Sharing and Usage / Exporting
AMP owns the information compilations or data files collected from Customers that use its text marketing service as well as their Subscribers’ contact information and other data. AMP allows Customers to access Subscribers’ mobile phone numbers and other contact information supplied by Subscribers or developed by Customers during the term of service that AMP and the Customer agree to under contract. A “Subscriber” is defined as any person who has opted-in through the AMP text marketing service to receive messages from a Customer via a mobile keyword.
AMP does not share, sell, or rent any contact information with any party unless AMP obtains explicit or implied consent from the owners of such contact information. An implied consent is when your subscriber texts a Customer’s mobile keyword to AMP’ short code 36000. Customers may not send messages via the AMP text marketing platform to the owners of mobile devices who have not opted to join their text marketing list. AMP contractually restricts Customers from sending messages to their Subscribers on behalf of an unrelated third party unless explicitly approved by and purposefully facilitated by AMP. AMP reserves the right to deny the sending of messages from Customers to their Subscribers in its sole discretion and if sending messages is permitted the Customer shall be responsible for the content of the message.
AMP Customers are not allowed to share their Subscribers’ contact information that they have access to with any third party for any reason. AMP may use or disclose information, including your personal information and your subscribers’ contact information, without limitation, under the following circumstances:
- To enforce our Terms of Use or other legal agreements.
- To outsource certain support activities, such as billing, customer service, or responding to inquiries.
- To establish or exercise our legal rights or defend against legal claims.
- To a company controlled by, or under common control with, AMP for any purpose permitted by this Privacy Policy.
- When AMP believes such use or disclosure is (a) necessary in order to investigate, prevent, or take action regarding suspected illegal activities, fraud, or situations involving potential threats to the physical safety of any person, or (b) required by law. In the event of a merger, acquisition, consolidation, divestiture, or bankruptcy of AMP.
- AMP Text Marketing is not intended for children under 13, and AMP does not knowingly collect information from children under the age of 13.
TEXT MARKETING ANTI-SPAM POLICY
The AMP text messaging service is provided using the following short code (the “From” on a received message) 36000. AMP allows only verified opt-in subscriptions, and the service ensures that all subscribers can opt-out quickly, easily, and permanently from unwanted text messages. This is done by replying to a received text message from the short code 36000 with one of the following words; STOP, END, CANCEL, STOPALL, UNSUBSCRIBE, or STOP + any keword.
Our Definition of Spam
We consider any unsolicited, unexpected, or unwanted text message as Spam. We do NOT allow sending of messages to 3rd party lists without incontrovertible proof of assent from the individuals represented on those lists to the receiving of text messages from the sender.
AMP Anti-Spam policy
AMP follows an ANTI-SPAM policy for all of its communications protocols. This means that we have a zero tolerance for UNSOLICITED TEXT MESSAGES; NOTIFICATIONS; ALERTS; OR ANY MESSAGES THAT YOU MAY RECEIVE FROM SOMEONE WHO SHOULD NOT HAVE YOUR MOBILE NUMBER. Please let us know about any suspected abuse, with the sender name (shown at the beginning of the message), your mobile number (to be removed); the date and time you received it and the contents of the message. To report any abuse or violations of inappropriate use of our service, please contact us with your comments/complaints. Your report will be registered and the Client will be investigated for violations of our Anti-Spam Policy. The identity of any individual reporting abuse will be kept confidential.

Anti-Spam Policy Enforcement
On our terms and conditions agreement, our Clients specifically agree NOT to use AMP to send unsolicited text messages or Spam, and agree on the Opt-In only policy for their list. All recipients of text messages sent using the AMP text marketing service can easily and immediately opt out from receiving any further text messages by replying to a received text with one of the following words: STOP, END, CANCEL, STOPALL, UNSUBSCRIBE or STOP (+ any keyword.)
If we suspect a violation of our Anti-Spam policy, we will contact the Client and discuss the Client options, which may range from a warning, to termination of service for that Client. To the best of our knowledge, our text marketing service adheres to ALL local, state and national laws regarding sending unsolicited bulk / group text messages.
Spam and Abuse Report
STOP, END, CANCEL, STOPALL, UNSUBSCRIBE and STOP (+ any keyword.) To remove yourself from any list, reply to any of the received text messages with any of the aforementioned keywords above.
If, after you have opted out, you continue to receive unwanted text messages, please email us at abuse@www.ampcorporate.com with “STOP”, “QUIT”, “CANCEL” or “UNSUBSCRIBE” in the subject line. Include your mobile number in your email, along with the name of the business that the text message came from (the first part of the message will identify the business), and the contents of the text message. You will be removed from that list and the Client will be restricted from adding your mobile number to their list in the future. You may also contact us via phone and mail, as detailed above.

Consent to receive texts is not required to buy goods or services, message and data rates may apply, and you may reply back STOP at any time to be opted out of any further communications via text. If you invite your friends to join any AMP Program by providing their contact information, or by allowing us to use your address book from your computer, mobile device, or other sites we may communicate to your friend’s contact information enough to process your requests.
Transactional Information:
If you record punches, points, redemptions, purchases or other transactions through the Application, we may collect and store certain information about you to process your progress, or to track your progress toward rewards or incentives, or to facilitate future transactions, or to faciliatate future marketing initiatives, such as your phone number, address, and email, and credit card information. This information may be shared with third parties including the businesses who you interact with in the Application.
